1. Safety Commitment Statement

Luxcar Pty Ltd is committed to ensuring that all commercial passenger vehicle services facilitated, arranged, or provided through our platform are delivered safely, responsibly, and in compliance with applicable laws and regulations.

Safety is our highest operational priority.

Luxcar is committed to:

• Identifying and managing safety risks

• Maintaining a documented Safety Risk Register

• Ensuring driver competency and fitness

• Maintaining safe and roadworthy vehicles

• Promoting open safety reporting

• Continuously improving safety performance

This Safety Management System applies to:

• All associated drivers

• All associated commercial passenger vehicles

• All staff and contractors

• All services arranged by Luxcar Pty Ltd


2. Safety Governance & Responsibilities
2.1 Safety Responsibility

The Director of Luxcar Pty Ltd holds overall responsibility for:

• Safety compliance

• Maintaining the Safety Management System

• Reviewing and updating the Risk Register

• Incident management and corrective actions

• Ensuring driver compliance with safety obligations

2.2 Associated Drivers

All associated drivers must:

• Comply with road laws and commercial passenger vehicle regulations

• Maintain valid driver authorisation and required accreditations

• Operate vehicles safely and professionally

• Report safety risks, hazards, incidents, or near misses

• Participate in required safety training


3. Safety Risk Register

Luxcar maintains a documented Safety Risk Register to:

• Identify potential hazards

• Assess risk likelihood and consequence

• Apply control measures

• Monitor and review risk effectiveness

The Risk Register is reviewed:

• Annually

• Following significant incidents

• When operational changes occur


4. Identified Safety Risks & Control Measures
A. Driver Fatigue

Risk: Reduced alertness due to excessive working hours.

Control Measures:

• Maximum working hour guidelines

• Mandatory rest periods

• Driver self-declaration of fitness before accepting bookings

• Monitoring of booking allocation patterns

• Drivers must decline bookings if fatigued

Drivers are prohibited from operating if not fit for duty.


B. Drug and Alcohol Management

Risk: Impaired driving due to substance use.

Control Measures:

• Zero tolerance policy

• Drivers must not operate under the influence

• Fitness-for-duty declaration

• Random or reasonable suspicion testing (where applicable)

• Immediate suspension pending investigation if suspected

Confirmed breaches result in immediate removal from service.


C. Vehicle Maintenance & Roadworthiness

Risk: Mechanical failure affecting passenger safety.

Control Measures:

• Vehicles must hold valid commercial passenger vehicle registration

• Compliance with inspection and roadworthy requirements

• Servicing in accordance with manufacturer schedules

• Daily pre-start vehicle inspections

• Immediate reporting of mechanical defects

• Removal of unsafe vehicles from service


D. Emergency Management

Risk: Accidents, breakdowns, or passenger emergencies.

Control Measures:

• Clear emergency response procedures

• Drivers instructed to contact emergency services immediately where required

• Incident reporting within 24 hours

• Insurance notification protocols

• Post-incident review process

Passenger safety is prioritised at all times.


E. Driver Behaviour & Professional Conduct

Risk: Unsafe driving or inappropriate conduct.

Control Measures:

• Professional conduct standards

• Defensive driving expectations

• Speed compliance requirements

• Monitoring of complaints and feedback

• Investigation of all safety-related complaints

• Removal for serious misconduct


F. Driver Competency & Medical Fitness

Risk: Driver unable to safely perform duties.

Control Measures:

• Valid driver authorisation required

• Compliance with medical fitness standards

• Mandatory disclosure of medical conditions affecting driving ability

• Periodic review of documentation


G. Training & Safety Awareness

Risk: Insufficient safety knowledge.

Control Measures:

• Driver onboarding safety briefing

• Ongoing safety updates

• Written policies and procedures

• Incident learnings communicated to drivers

• Clear reporting channels

Training includes:

• Fatigue management

• Emergency response

5. Incident Reporting & Investigation

Drivers must report:

• Collisions

• Injuries

• Passenger incidents

• Near misses

• Mechanical failures

• Safety complaints

Incident Process:

  1. Ensure immediate safety

  2. Contact emergency services if required

  3. Notify Luxcar

  4. Complete incident report

  5. Investigation conducted

  6. Corrective actions implemented

  7. Risk Register updated if necessary

All incidents are documented and reviewed.


6. Driver Fatigue Management Framework

Luxcar implements:

• Monitoring of booking hours

• Rest break requirements

• Fitness-for-duty confirmation

• Escalation where excessive hours are detected

Drivers must not accept work when fatigued.


7. Drug & Alcohol Policy

Luxcar enforces a strict zero-tolerance approach.

Drivers must:

• Be drug and alcohol free while on duty

• Not consume alcohol or illicit substances prior to work

• Comply with testing requirements if requested

Non-compliance results in immediate suspension and investigation.


8. Vehicle Safety & Inspection System

All associated vehicles must:

• Meet commercial passenger vehicle standards

• Be maintained to manufacturer specifications

• Be kept clean, safe, and mechanically sound

Drivers must complete:

• Daily pre-start safety checks

• Immediate defect reporting

Unsafe vehicles are prohibited from operation.


9. Safety Reporting & Whistleblower Protection

Safety concerns may be reported via:

• Email: compliance@luxcar.com.au

• Direct management communication

Reports may be made confidentially.

Luxcar prohibits retaliation against any person reporting safety concerns in good faith.


10. Continuous Improvement

Luxcar conducts:

• Annual Safety Management System review

• Risk Register updates

• Complaint trend analysis

• Performance monitoring

• Compliance audits

The SMS is updated when:

• Legislation changes

• New risks are identified

• Following serious incidents
